In a bold move, 24 Democratic-led states and cities have filed lawsuits against President Donald Trump's executive order aimed at ending birthright citizenship in the US. The lawsuits, filed on Tuesday, allege that Trump's order violates the 14th Amendment of the Constitution, which grants citizenship to all children born in the United States.¹
At the heart of the issue is the Constitution's guarantee of birthright citizenship, which has been upheld by the Supreme Court twice in the past. New Jersey Democratic Attorney General Matthew Platkin, co-leading the lawsuit, emphasized that while the president has the right to propose policy agendas, he cannot unilaterally rewrite the Constitution.
The lawsuits were filed in two separate courts: 18 states, Washington, DC, and San Francisco filed in a Massachusetts federal court, while the attorneys general of Washington, Arizona, Oregon, and Illinois filed their own lawsuit in a Seattle federal court. Both suits seek a preliminary order blocking the policy before the Trump administration can implement it.
This legal showdown could potentially become the first major Supreme Court challenge for Trump's second-term agenda. The Supreme Court has consistently upheld birthright citizenship, and there is also a federal law establishing that children born on US soil are entitled to citizenship.
The American Civil Liberties Union and immigration rights groups have also filed similar lawsuits targeting Trump's order. As the legal battle unfolds, one thing is clear: the fate of birthright citizenship hangs in the balance.
